Chippewa County WQOW) – The young girl accused of killing six-month-old Jaxon Hunter is having her case moved to juvenile court.
That was the decision made by Judge James Peterson on Friday afternoon.
The girl’s legal team presented a motion to have a guardian ad litem appointed for the purposes of waiving the preliminary hearing and recommending a reverse waiver. They argued the girl’s “capacity to make adequately considered decisions such as whether and how to waive a preliminary hearing is somewhat diminished.”
The court accepted that motion.
Because that motion was accepted, it opened the door for the suspect to be moved to juvenile court.
Last month, the girl was found not competent to stand trial. She was also found not competent during a hearing back in March.
During that hearing in September, the defense pushed for the girl to be moved to a juvenile jail, as opposed to staying with adults.
The girl, who News 18 is not naming, was just 10 years old when Jaxon Hunter died last October.
